Booking Terms & Conditions for the 2024 Radiant Woman Holistic Alignment Program & Yoga Retreat
These Terms and Conditions (the “Terms”) apply to any retreats, or services you have booked with or purchased from Mystic Gardens Healing LLC (MGH) and govern the contractual relationship between you and, Mystic Gardens Healing (MGH) with respect to any such travel products (passport covers, guides, masterclasses) and/or services (hereinafter, the “Products”). Please read these Terms carefully as by booking any Product with Mystic Gardens Healing you acknowledge that you: i) have read and understand these Terms, and ii) indicate your express acceptance of and agree to be bound by these Terms. If you have confirmed a booking on any Products with more than one Buyer named and booked on such booking, you shall be deemed to have accepted these Terms on behalf of all Buyers named in the booking and traveling on or otherwise participating in any Products (hereinafter “you”, the “Buyer(s)”), and by such travel or participation all participants indicate their assent to these Terms. The Buyer who confirmed the booking is deemed to be the designated contact person for all other Buyers named in such booking. These Terms constitute the entire agreement between the Buyer and Mystic Gardens Healing with respect to the subject matter thereof and supersedes all prior agreements, representations and understandings of the parties, written or oral.
1. The Booking Contract
A booking is confirmed and these Terms shall apply when Mystic Gardens Healing (MGH), or an authorized agent acting on Mystic Gardens Healing behalf, have received the applicable deposit from the Buyer and the Buyer has received electronic confirmation from Mystic Gardens Healing of such booking. Sales tax is not included. The Buyer confirming the booking must be no less than 18 years of age and agrees to provide full, complete and accurate information as requested by MGH to confirm such booking. Any Buyer confirming a booking on any Retreat, Products etc with more than one Buyer named and booked on such booking represents and warrants to MGH: i) they have all requisite consents and authority to make such booking on behalf of all other Buyers named on the booking, and have communicated all necessary information to the other Buyers in order for them to give free and fully informed authorization to do so; ii) the information that they are providing regarding all Buyers is complete and accurate, and they have obtained all necessary consents and permissions to share such information with MGH for the purposes of completing the booking; and iii) they will inform all other named Buyers on the relevant booking of the applicability of these Terms to the booking and the Buyers’ relationship with MGH.
At any time before a booking is confirmed, MGH reserves the right to increase or decrease brochure prices of any Products. MGH reserves the right to decline any booking, in their sole discretion.
2. FINAL PAYMENT SCHEDULE/LATE PAYMENT/ACCEPTANCE OF BOOKING/Buyer DETAILS
FINAL PAYMENT(S): Buyers should refer to the confirmation email sent by MGH and/or their applicable confirmation email for details regarding mid balance, and final payment. All payments must be made on time in order to keep your space, no exceptions.
Please Note: Our spaces fill up fast. If there are spaces left in May and you book the retreat after May, the payment breakdown will change, and your payments will be due earlier.
Buyer Details: As a condition to valid confirmation of any booking with MGH, the Buyer must provide all necessary information as requested by MGH along with their final payment. If the Buyer fails to provide such information prior to 30 days before the departure of the purchased Product, an Administrative Fee of $50 will be charged to the Buyer, and MGH reserves the right to treat such booking as cancelled.
Credit Card/Paypal/Bank Charges:MGH is not responsible for any charges levied or charged by third parties and/or financial institutions and payable by the Buyer as a result of credit card or other payment transactions in connection with the purchase of Products and will not refund or return any fees charged by such third parties.
3. CANCELLATION BY THE Buyer
Mystic Gardens Healing Retreats, Experiences and Events are non-refundable. All payments are non-refundable. This includes for reasons of COVID-19 or any occurence. We strongly suggest that clients purchase travel insurance for any cancellation reason because you can request a refund through your travel insurance for any reason.
Buyers purchasing Products are highly recommended to purchase comprehensive cancel for any reason insurance, to the extent such insurance is available under the laws governing each Buyer's country of origin.
4. Postponed Retreat (MGH)
In the case that Mystic Gardens Healing postpones a retreat, a refund may not be issued as all payments are non-refundable. However, MGH will determine this based on circumstances. This includes for reasons of COVID-19 or any other occurrence. You agree that MGH will not be liable for a canceled retreat for circumstances beyond reasonable control, including acts of civil or military authority, national emergencies, fire, mechanical breakdown, flood or catastrophe, acts of God, epidemic, pandemic, insurrection, war, riots, or failure of transportation, communication, or power supply. However, the participant's retreat ticket will be transferred to a future retreat, or participants will have the option to transfer their ticket to another person. However, If the participants has travel insurance, they will be able to request a refund through their travel insurance and follow their travel insurance policy. Buyers purchasing Products are highly recommended to purchase comprehensive cancellation for any reason insurance, to the extent such insurance is available under the laws governing each Buyer's country of origin.
(a) Mystic Gardens Healing has the right to postpone a retreat or event with 24-hour notice.
(b) Mystic Gardens Healing is not responsible for any incidental expenses or consequential losses that the Buyer may have incurred as a result of the canceled booking, such as visas, flights, transportation, any fees or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc.
5. UNUSED SERVICES
MGH shall not offer or pay any discounts or refunds for missed or unused services which were missed or unused by the Buyer due to no fault of MGH or the MGH Team, which shall include any termination of the Buyer’s participation in the tour Product due to the Buyer’s own fault, negligence or breach of these Terms.
6. VALIDITY
The prices of Products advertised on the Mystic Gardens Healing website are based on costs in effect at the time of posting to the website. MGH reserves the right to alter prices of any Product at any time prior to receipt of payment in full for such Product. Changes, revisions, or other amendments may be made to the particulars contained on the Mystic Gardens Healing website before a contract is concluded, and such changes, revisions or amendments shall be incorporated herein as of the date of such amendment.
7. FLEXIBILITY
The Buyer acknowledges by booking a Product and/or agreeing to travel with MGH that the nature of this type of travel requires flexibility and acknowledges that they will permit reasonable alterations to the Product and/or itinerary by MGH. The Buyer acknowledges their understanding that the schedules, itineraries, and amenities may be subject to change without prior notice due to circumstances or events, which may include sickness or mechanical breakdown, incidents in the location where the Product will be operated, extreme weather and other unpredictable or unforeseeable circumstances which are beyond the reasonable control of MGH.
8. BEHAVIOR
Participants can be told to leave the retreat if they consistently portray aggressive, confrontational, argumentative etc behavior with other participants or any staff. Participants will be asked to leave the retreat, and a refund will not be issued.
9. CHANGES
(a) Retreat details: The agenda is a general guide to the retreat and region and any mention of specific activities is not a guarantee that they will be offered, nor does it form part of the contract between the Buyer and MGH. Although the agenda has been curated with care and details are provided in good faith, MGH may make improvements that stem from weather changes, local factors, past travelers’ comments, and research, to name a few examples. As a Buyer, you also expressly acknowledge and assume responsibility for inherent risks associated with physical activities you participate in.
(b) Changes made by MGH: While MGH will endeavor to operate all Products as advertised, reasonable changes in the itinerary of any Product may be made where deemed necessary or advisable for operational reasons by MGH, in its sole discretion. If MGH makes a Material Change (defined as a change affecting at least one in three full retreat days of the agenda, or which materially affects the character of the Product in its entirety) to any Product, MGH will inform the Buyer(s) booked on such Product of any Material Change as soon as reasonably possible, provided that there is sufficient time before departure to properly notify all affected Buyers. If a Material Change is made more than 12 days prior to departure, the affected Buyer may elect to:
(i) accept the Material Change and proceed with the amended Product;
(ii) book another Product of equivalent or greater value, if available (Buyer shall be responsible for paying any difference in price between the amended Product and the Product booked in its place);
(c) MGH has the right to cancel a retreat or event with 24 hour notice.
The affected Buyer must notify MGH of their decision in writing within 7 days of receiving the notification of alteration, or they shall have been deemed to accept the Material Change and deemed to have agreed to the amended Product itinerary.
Once a Product experience has departed, changes to such Product’s itinerary may be necessary or advisable as a result of unforeseen circumstances or other reasons related to effective Product operation, health, safety, Buyer enjoyment, or Buyer comfort. Any such changes are at the discretion of MGH and any indirect costs incurred as a result will be the responsibility of the Buyer. The Buyer acknowledges that they must have reasonable financial resources to cover incidental expenses on every Product , whether or not they arise from a change in the itinerary or from the travel itself, and that MGH shall not be liable for any Buyer’s failure to prepare adequately for their travel and unforeseen circumstances which may arise during such travel.
MGH will not be liable for any indirect and/or consequential losses associated with any changes to a Product’s itinerary.
10. CODE OF CONDUCT
Welcome to the beautiful hills of Mendocino County, and thank you for being part of the MGH experience. We are thrilled that you chose to come on this healing journey with us. Before we can get started with our activities, please read and agree to the following Code of Conduct. This code of conduct applies to your entire duration with us:
There is a zero tolerance hate policy for any offensive verbal comment related to gender, sexual orientation, disability, physical appearance, body size, race, religion, or other personal lifestyle choices. If this behavior is detected, we will handle it accordingly: participants will be asked to stop any hateful or disrespectful behavior immediately. If the negative behavior persists, the organizers and participants of the space will take appropriate action such as mediation or asking the offender to leave.
**Please do not feel burdened to bring this behavior to our attention. We want to maintain a compassionate healing energy for the duration of our retreat, and to do that we depend on the honesty of our teachers and participants. **
11. MEDIA
The zero tolerance hate policy extends to negative postings on any form of public website or social networking, i.e. Facebook, Instagram, Snapchat, Twitter, etc. Should you post something before or after the retreat, affiliated with Mystic Gardens Healing that the organizers feel does not align with the sisterhood and mission of Mystic Gardens Healing retreats, you will be asked to remove or edit the post. Should a participant defame, slander etc MGH, leaders of the retreat, or affiliates, the participant will be penalized with $10,000 fee payable to Francisca Crutchfield, Mystic Gardens Healing LLC and/or further legal action.
Please be courteous to fellow participants by asking for permission before taking or posting pictures that include others.
Photos of alcoholic beverages or herbal supplements should not be posted with affiliation to MGH.
Below are a few definitions of behaviors that will NOT be accepted. Please read each.
Racism: Prejudice or discrimination against individuals with a skin tone of color or of a specific ethnic group.
Body Shaming: Negative statements and attitudes toward another person's weight or size. It can also reach into discrimination against individuals who may be overweight or underweight.
Sexuality and Gender Discrimination: Treating individuals differently because of their sexuality. Negative statements or discrimination against heterosexuality, homosexuality, transexuals, or transgenders.
Religious discrimination: Treating individuals differently because of their religion, their religious beliefs and practices, and/or their request for accommodation for such. *This definition applies to Atheism.*
Cigarettes + Tobacco
Cigarettes and Tobacco are not permitted throughout the retreat. However on the Saturday night of the retreat, you will be able to have the option to engage in such as long as you are far enough from the group for it not to affect anyone else.
Telephones
Telephones will not be allowed during workshop or class times. All guests within the retreat must leave their telephones in their room during all workshops or classes. We also recommend putting on vacation responders and telling people at home that you are going away for a weekend to focus on yourself, this will allow you to be fully immersed with the retreat, we want you to come present and ready to practice deep self development and learning.
Creatures of the Region
Although the retreat property may appear developed it is very much where the Redwoods and wilderness meets the lodge. Bugs, birds, deer, river otters, and other animals have their home throughout the region. Participants are asked to practice (ahimsa) non-violence with the creatures of the region. We prefer to keep the creatures alive. If you are afraid of an animal, we suggest remembering that the animal is probably just as scared as you ;-)
Community

Meal Time
All participants must be present at all meal times.
Personal Responsibility
We ask that participants practice personal responsibility by showing up for themselves. Participants should be sure to show up to all activities on time. If you are late for a workshop or yoga class, you may not be permitted within the class, this depends on the class.
Advertising at a retreat
Advertising and promoting brands and companies by guests outside will not be permitted during any time. This extends to passing out flyers, wearing tee shirts, bracelets etc that advertise a brand and all forms of promotion and advertising. If you are interested in promoting an outside brand, you must seek written permission prior to arriving at the retreat.
Refusal to comply with any conditions within this code of conduct will result in your immediate removal from the retreat with no refund, and/or further legal action. Once again, thank you for attending MGH retreats! Below is the Media Consent Form and Liability waiver.
MEDIA CONSENT FORM
I hereby consent and authorize an employee or agent of Mystic Gardens Healing to take photographs or motion pictures of me or other types of media productions that capture my name, voice, retreat experience and/or image.
I authorize Mystic Gardens Healing to copyright the materials, and I authorize Mystic Gardens Healing to use, reuse, copy, publish, display, exhibit, reproduce, license to third party, and distribute the Materials in any promotional materials or other forms of media, which may include, but are not limited to social media, retreat websites or publications, magazines, articles, electronic or otherwise, without notifying me. I also agree that the MGH may identify me by name and/or social media title, city ,state or country, occupation etc. I agree that I am participating on a voluntary basis and I will not receive any payment from MGH for agreeing to this release or as a result of any publication of the materials.
Liability
I will be participating in the Mystic Gardens Healing Women’s Holistic Alignment Program and Yoga Retreat in Mendocino County, California. I hereby release and indemnify Mystic Gardens Healing LLC and its staff and volunteers, from any and all liability arising from claims of any kind or nature whatsoever from my participation, including but not limited to accidents with any physical activity included in this retreat. I understand that if I violate any laws regarding possession of alcohol and/or weapons, or rules governing the retreat, I will be asked to leave the retreat. In the event that the undersigned cannot be reached, and in the judgment of the creator, Francisca, at this retreat or other staff members, there is necessity for immediate medical examination and/or treatment of myself, I hereby authorize any of the aforementioned personnel to obtain such medical services as are deemed necessary. I understand that voluntarily attending the Mystic Gardens Healing Retreat may involve certain risks beyond the reasonable control of the Mystic Gardens Healing staff and volunteers and agents in connection with the retreat, associated with the retreat, including but not limited to accidents, emergencies, exposure to reckless conduct of other persons, and/or negligence of and that Mystic Gardens Healing retreat disdain any and all responsibility for any such risks. If at any time during the retreat, attendees attempt to leave the event to attend a different event, and do so without the permission of Mystic Gardens Healing staff and leaders will be subject to dismissal from participation in the retreat.
